Many people are referred to our office because they are facing foreclosure. Unfortunately Missouri is a non-judicial foreclosure state. This means that the lender does not have to go to court to start a foreclosure. So when we fight a non-judicial foreclosure we don’t defend a lawsuit instead we must become the plaintiff and become the aggressor. Generally we ask for an injunction. If the foreclosure already occurred we can file an action for wrongful foreclosure. In either case we have the burden of proof, which means that winning can be difficult. If you receive a foreclosure notice you need to act quick, but know that unless there is a genuine mistake by the lender stopping the foreclosure can be difficult.
